I am the developer of "Sleepy Baby FREE" in the AppStore (and on other platforms). My app plays music for children to fall asleep to, and has an animation on screen to act as a soothing distraction. I have been challenged about trademark infringement. I'm not sure where I stand. The company sells a CD called "Sleepy Baby" with soothing childrens music. Actually they don't have to register the trademark to own it. If they made a product and claimed trademark (mentioned TM somewhere) it's theirs. Registering the trademark just makes it stronger. Since they are selling CDs and I assume all over the world, they can claim the trademark in any country. I'd save attorney's fees and just change the name of the app. The app name doesn't really matter much in terms of sales. |

This weekend was full of some great times with family!? I hosted a baby shower for my sister-in-law that turned out beautiful!? I can't wait to share the details with you soon!
I also got to see my new niece, Lucy!? She is still in the NICU but is getting stronger every day.? They are hopeful that she will get to come home on Wednesday!
On our travel home?from Iowa to Minnesota, we hit a deer.? A large deer.? We are pretty sure that my car is totaled.? My hubby was driving and he did such an amazing job at staying calm, handling everything and calming me and the boys down.?
We were really lucky that no one was hurt.?
I cannot begin to tell you how greatful I am for every
single person that helped us.?
The Sheriff that helped us and gave us a ride 20 miles to the nearest hotel for the night {we were 2 hours from home},
she was so?great and my boys will always remember that ride in the the cop car{It better be their only}!?
The little guy thought it was great, the big boy did not.? Ha!
This all happened on a holiday weekend at 11pm, and we are fairly new to the area.? So, not only did we not really know anyone close to give us a ride home on Sunday, there were no rental cars available either.? But, we were able to have a taxi drive us the two hours up to the cities.? We could not have been happier to get home and feel like we weren't stranded any longer. The taxi company wasn't working normal hours, so we are?very lucky they were able to give?us a ride that?far!?
Our weekend did not end the way we thought, which makes me very aware of the fact that we are not in control of our lives.? I have prayed many times, how thankful I am that we are all ok.?
So, our journey for a new vehicle begins.?
If I don't post as much this week, I hope you understand why.?

ST. LOUIS ? Chase Utley was in a chipper mood Sunday morning, a telltale that his knees were feeling pretty good.
?My knees the last week or so have felt better than they have in a while, which is kind of what we?ve been working toward,? he said. ?I?m progressing well. Every day seems like it?s getting a little bit better.?
Utley stepped up his workouts at second base on Friday and Saturday, taking between 25 and 30 ground balls at the position each day. Some of the ground balls forced him to move side to side ? ?A little bit quicker and a little harder,? he said ? and he did a lot of throwing to first Saturday. On Friday, he spent a lot of time reading balls off the bat during batting practice. He also chased down balls in left field, where the grass is easier on his knees. He said that was a good way for him to work on his agility.
?The last couple of days we?ve pushed it and increased the intensity a little and they?ve [the knees] responded well,? he said. ?That?s a good sign in my eyes.?
Utley said he plans to accompany the team to New York for a three-game series that begins Monday. He still does not have a timetable for when he will report to Florida to play in minor-league games. He will make the call depending on how his knees feel.
?I think it?s just more of a feel,? he said. ?Right now I?m taking anywhere from 20 to 40 ground balls. The last few days have picked up that intensity as far as range and how hard I?m going after the ball. There?s a bit more of a process and I?ve worked a little harder. It?s encouraging that the following day I feel the same as I did the day before.?
Utley said he does not know what the next step in his rehab will be, ?But I?m encouraged by the way it has gone the past week or so.?
Returning as a second baseman is still Utley?s plan. However, his recent workouts in left field have left some to wonder if playing there would reduce pressure on his knees. Darren Daulton moved from catcher to right field after his knees were shot.
Would left field be a possibility for Utley down the road?
?I haven?t thought too much about it,? he said.

The CBC (Canadian Broadcasting Company) has come up with a, shall we say, intriguing gimmick for the Stanley Cup finals this year. ?It will be introducing While the Men Watch, a
live, sports talk show for women. Hosted by Lena Sutherland and Jules Mancuso, the program [will follow] the discussion of two women watching sports ?from a woman?s point of view including everything from interpreting the rules of the game to coaches in need of a makeover.? ?Apparently, it?s been called ESPN meets ?Sex & the City.?
Ya, because that?s what the world needs ? ESPN and Sex & The City in one show. ??Female non-hockey fans? will be able to go online to ?listen to an alternate commentary from [Sutherland and Mancuso].? CBC has received considerable backlash from both genders concerning the show synopsis:
As two women married to sports fanatics, there was really no escaping hockey on TV ? especially during playoffs. As our men were glued to the game, we were on the phone talking to each other about what we saw on the ice in a way that was completely different than what our guys or the real announcers were saying. ?Why were the players getting a seat and a drink in the penalty box if it?s supposed to be a punishment? And how exactly did that coach pick out a brown suit and tie combo four sizes too big?
Congratulations CBC! You have officially regressed to the 1950?s. ?Women having their own sports talk show isn?t a bad idea. ?Having them talk about it from a woman?s perspective isn?t a bad idea. ?But, and I hope that when the show airs this introduction statement was meant to be more inflammatory than true to form, having a show premised on the idea that women and men fundamentally experience hockey (or any sport) differently is detrimental to both genders. ?Also, saying that what these women discuss can be ?completely different [from]?the real announcers? say implies that men are the only ones able to really announce hockey. ?Puck Daddy calls out the CBC highlighting the fact that it has Helene Elliott and Cassie Campbell as hockey commentators on their staff who represent the opposite end of the spectrum of Mancus and Sutherland. ?However, as the Winnipeg Free Press reports:
Julie Bristow, executive director of studio and unscripted programming for CBC Television, said she doesn?t think the optional commentary is sexist.
?We think this is a really interesting and fun way of engaging people in our national sport ? both men and women,? she said.
?I think it really just captures the kind of conversation that happens in living rooms and bars across the country when hockey is on.?
In an email, Canadian gold medallist Hayley Wickenheiser said she looked forward to hearing it.
And in a press release, Cassie Campbell-Pascall, an analyst on CBC?s ?Hockey Night in Canada,? said she too wanted to hear the alternate game call.
?I think it?s going to be a lot of fun for more casual viewers,? she said.
Say it ain?t so Hayley and Cassie! Sutherland defends the show as ?all in good fun? but just because it?s fun doesn?t mean that it?s not counterproductive. ?Also, are we assuming that the casual viewer wants a different type of commentary?
Puck Daddy asks if this show is sexist or incredibly sexist? ?I?m not entirely sure that there are degrees of sexism. As I see it this is one of those you?re either dead or you?re not ? there are no degrees of death. ?I was inclined to say incredibly sexist because this show pigeon-holes both genders into two very defined and confining boxes, but doesn?t all sexism do that? Since we live in a dichotomous society whereby everything is either or (e.g. straight or gay, white or non-white, conservative or liberal) that means that what happens to one side must also affect the other, whether ?positively? or ?negatively?. ?Putting women back into the archaic ?you don?t understand sport because your feminine brain cannot conceive of the strategy and skills going on? box also places every man into the ?you love sport, understand all sport and are less of a man if you don?t bond with other men over sports? box. ?Maybe the show will turn out to be slightly more insightful than what has been proposed thus far; therefore, I suppose I will have to watch an episode or two and report back (I?m taking one for the team here folks!). But for now, to the CBC I say ? stop putting your viewers into boxes! ?You already have Don Cherry to do that for you.

INDIANAPOLIS -- There was nothing soft about Dwyane Wade and the Miami Heat.
Wade scored 41 points, LeBron James chipped in 28 and the Heat finished off the Indiana Pacers, locking up a return trip to the Eastern Conference finals with a 105-93 victory in Game 6 on Thursday night.
The Heat wrapped up the best-of-7 series and will face either Boston or Philadelphia in the next round starting in Miami on Monday. Of course, nothing less than an NBA title will make for a satisfying summer in South Beach.
Two series down, two to go.
The Heat rallied from an early 11-point deficit, riding the hot hand of Wade in the opening half. He scored 26 points by the break, tying Tim Hardaway's 16-year-old franchise record for most playoff points in the first two quarters. James hit consecutive baskets with just over a minute remaining to close it out.
Next up, the Celtics or surprising 76ers. The Heat will get a much-needed chance to relax before worrying about the next opponent, which will be determined in Game 7 at Boston on Saturday.
David West led Indiana with 24 points and all five starters were in double figures. But that balance was overwhelmed by Wade and James.
In a game of spurts, the decisive one came in the closing minutes of the third quarter, the Heat pushing out to their third straight impressive win after falling behind 2-1 in the series.
The Pacers tied it at 66 on Darren Collison's 3-pointer, but it was all Heat the rest of the period. They closed on a 13-3 run, capped by Mario Chalmers' buzzer-beating 3 from the corner. Wade, who was on the bench getting his customary breather at the end of the quarter, leaped from his seat as the ball left Chalmers' hand at the far end, raced along the baseline and pumped his fist when it swished.
As Chalmers raced toward the Miami bench, Wade greeted him near the free throw line with a low-five.
For the most part, D-Wade did his best work while in the game.
He dropped 11-of-16 shooting on the Pacers in the first half, but also made sure the MVP stayed involved, dishing off a behind-the-back pass to James for a thunderous jam.
Indiana clamped down a bit on No. 3 the rest of the way, but he still managed perhaps his most jaw-dropping basket. Darting into the lane, he threw up a wild-looking, one-handed shot that looked like it might go over the backboard, only to catch the top of the glass and drop through, barely touching the twine.
There was none of the nastiness that marked Game 5, when a bunch of flagrant fouls resulted in suspensions for two Miami players, co-captain Udonis Haslem and backup center Dexter Pittman. Pacers president Larry Bird was so disgusted with his team's performance that he accused them of going "soft."
That wasn't the problem this time. This was merely a Miami team on a mission, a mission that began in the summer of 2010 when the Heat signed James and Chris Bosh to join Wade in a seemingly unbeatable Big Three. There was a glitzy introduction and predictions of multiple championships, which left the rest of the league seething and plenty of people cheering when Miami was knocked off in the NBA finals by the Dallas Mavericks last season.
Shaking off that disappointment, James had perhaps his greatest season yet. But it was Wade who took control in the decisive game against the Pacers, delivering the final blow when he split West and George Hill, banking in the shot despite taking a knee from Hill that sent the Heat guard tumbling to the court.
The Pacers simply didn't have enough to match the Heat, even with the Big Three down to the Big Two because of an injury to Bosh.
Chalmers finished with 15 points, while Mike Miller stepped up to provide some quality minutes, scoring 12 points on four 3-pointers to help fill the void without Haslem, Pittman and Bosh.
When Miller wasn't in the game, he stretched out along the baseline to cope with his various aches and pains, more comfortable that way than sitting in a chair. When coach Erik Spoelstra called his number, Miller summoned several of his teammates to help lift him up.
The Pacers started out like they were intent on sending the series back to Miami for a decisive game that surely would have had all of South Florida on edge.
West knocked down a short jumper right off the tip, Danny Granger stuffed one off a fast break and the Pacers had their yellow-clad fans in a tizzy when Granger connected on a 3-pointer to make it 13-3 before the game was 5 minutes old. Another basket by Granger, this one a turnaround jumper, gave the Pacers their biggest lead at 19-8.
But Miami wasn't going to roll over that easy. Miller made the first of his 3s in the closing seconds of the first quarter, and Wade took over from there. He started the period by banking in a 12-footer, then made another short jumper to leave the crowd stirring uneasily. Miller followed with another 3 ? and just like that, it was all tied up.
Yet another 3 by Miller, this one a good 5 feet beyond the arc, gave Miami its biggest lead of the half, 41-35. Back came the Pacers, who went to the locker room with a 53-51 lead and hope of extending their season for at least one more game.
Turns out, they were down to their last half.

PHOENIX (AP) ? Arizona's secretary of state said Wednesday that Hawaii's official verification of President Barack Obama's birth records meets necessary requirements, meaning the president's name will appear on Arizona's ballot in the fall.
The inquiry launched recently by Arizona Secretary of State Ken Bennett gave official weight to a long-simmering political controversy generated by those who say that Obama was not born in the U.S. and therefore is ineligible to hold the nation's highest office.
The Obama administration attempted a year ago to dismiss the conflict by releasing his long-form birth certificate showing that he was born in Hawaii.
But skeptics maintained their stance and eventually Bennett announced he would seek further verification at the request of numerous voters who contacted his office, even saying he was prepared to leave Obama's name off the state's ballot in November.
Bennett, a Republican, said in a written statement that Hawaii officials "have complied with the request, and I consider the matter closed."
Bennett's office says Obama's name will appear on Arizona's November ballot as long as he wins his party's nomination and all paperwork is properly completed.
Obama campaign spokesman Mahen Gunaratna noted that Bennett also is Arizona campaign co-chair for Republican presidential contender Mitt Romney. Gunaratna said Bennett's inquiry will have no bearing on the election, "But it does present an opportunity for Mitt Romney to finally rise to the occasion and denounce the extreme voices in his party."
The Romney campaign responded saying the candidate has made his stance on the issue clear.
"I think the citizenship test has been passed," Romney said to CNBC in April, a statement relayed to The Associated Press by his campaign on Wednesday. "I believe the president was born in the United States. And there are real reasons to get this guy out of office."
Hawaii State Registrar Alvin Onaka sent the document Tuesday confirming the information on Obama's birth certificate, such as the Honolulu hospital where he was born and the names and ages of his parents.
Hawaii officials have repeatedly verified Obama's citizenship as skeptics have maintained that the president was born in Kenya, his father's home country.
State and federal courts also have rejected lawsuits over the issue.
The verification process was the subject of three months of back and forth, with Hawaii officials initially saying Bennett had to show why he needed the information as part of ordinary business.
Other Arizona officials over the last year have raised questions about Obama's birth certificate.
Last year, the state Legislature passed a bill that would have required presidential candidates to prove their citizenship before their names could appear on the state's ballot.
The proposal was vetoed by Republican Gov. Jan Brewer, who called the measure "a bridge too far."
Maricopa County Sheriff Joe Arpaio, the self-proclaimed toughest sheriff in America, had a volunteer posse launch an investigation into the issue, saying in March there was reason to believe Obama's long-form birth certificate is a computer-generated forgery.
Arpaio, known for his hardline stance on illegal immigration, said Wednesday the information given to Bennett's office doesn't dispel his suspicions. He vowed to continue his posse's investigation until Hawaii officials provide microfilm of the original birth certificate or the original document itself.
Earlier this spring, Bennett's office made a change that requires candidates to complete a new form asking eligibility questions, including whether they are natural-born U.S. citizens.
In the past, political parties drafted their own certification documents that Arizona officials say didn't consistently address the issue of qualifications.
Democrat state Rep. Chad Campbell, Arizona's House minority leader, called on Bennett to step down as co-chair of the Romney campaign, saying if he doesn't, then he should resign as secretary of state.
Bennett declined through a spokesman to comment on Campbell's appeal.
