Miami awaits notice of allegations from NCAA

(AP) ? There was a spirit of cooperation that hovered throughout much of the NCAA's long probe of Miami athletics, so much so that the sides used to call the proceedings a joint inquiry.

That's not the case anymore.

And especially not now ? not after a day during which the NCAA defended its mistakes and Miami demanded a speedy resolution.

With the long-awaited notice of allegations against Miami looming ? and possibly being prepared for delivery by the NCAA as early as Tuesday ? the sides both made strong statements on Monday, first when the NCAA said its "missteps" would not derail the case, then when the Hurricanes rebutted by calling the probe "unprofessional and unethical."

"This is going to go forward," NCAA President Mark Emmert said.

Countered Miami President Donna Shalala: "We have been wronged."

A legal battle now seems possible, especially since Miami made its position clear on Monday: It will not accept any other sanctions other than the stiff ones it already has self-inflicted, a list that includes missing three postseason football games, holding back some football scholarships and declaring several players ineligible after they were found to be involved in wrongdoing.

"This process must come to a swift resolution, which includes no additional punitive measures beyond those already self-imposed," Shalala wrote.

The saga began with a Miami booster alleging that he plied athletes, recruits and coaches with impermissible benefits such as cash, yacht trips, lavish dinners and strip-club outings. In the past few weeks, the NCAA has had to acknowledge that it paid that booster's attorney to use subpoena power to depose witnesses who were unwilling to cooperate with the investigation.

The NCAA said it paid Maria Elena Perez, the attorney for former booster Nevin Shapiro, more than $19,000 for work she performed, primarily using subpoena power to ask questions on the association's behalf and doing so under the guise of a bankruptcy case. The NCAA does not have subpoena power and was not involved in Shapiro's bankruptcy proceedings.

Upon learning that Perez was willing to participate with investigators, members of the NCAA's legal team urged the enforcement department not to proceed, though they apparently were ignored. And now the depositions given by former Miami equipment-room staffer Sean Allen and former Shapiro business partner Michael Huyghue ? along with any other lead that came out of their interviews ? have been tossed from the NCAA's case against the Hurricanes.

"Based upon our review, it is our opinion that the current assertions in the U. Miami Investigative Record are not based on evidence that is derived, directly or indirectly, from the depositions of Mr. Allen or Mr. Huyghue," said a report into the NCAA's relationship with Perez.

The report was ordered last month after wrongdoing within the NCAA office was first acknowledged.

Perez did not immediately respond to a request for comment. The Florida Bar said last week that it has opened a file to see if Perez broke any rules through her involvement in the Miami-NCAA matter.

"Sadly the NCAA has not lived up to their own core principles," Shalala wrote. "The lengthy and already flawed investigation has demonstrated a disappointing pattern of unprofessional and unethical behavior. By the NCAA leadership's own admission, the University of Miami has suffered from inappropriate practices by NCAA staff."

Some of those NCAA staff are gone now, most recently and notably Julie Roe Lach. She was the NCAA's vice president for enforcement ? its top cop ? since 2010, and is now being replaced on a temporary basis by Jonathan Duncan, a lawyer with extensive experience working with the association.

"Obviously, this is an outcome that nobody wants to see on their watch or anyone else's," Emmert said. "This is something that's an embarrassment to the association and our staff."

Lach was part of the chain that approved payments to Perez, the attorney for Shapiro, a convicted Ponzi scheme architect now serving a 20-year term in federal prison. According to a 52-page report commissioned by the NCAA and released Monday, Perez offered her help to the NCAA in the form of "using bankruptcy subpoenas to compel depositions from witnesses who had refused to cooperate."

The NCAA, in turn, provided her with specific questions to ask, those coming in an email from former investigator Ameen Najjar, dated Dec. 18, 2011. "Maria, Listed below are a number of areas we would like you to explore," began the email from Najjar.

From there, he listed 34 questions, none of which seems to be in any way related to a bankruptcy case.

According to the NCAA, Perez billed the NCAA $57,115 for work performed from October 2011 through July 2012 ? though Lach and other officials were expecting the amount of her work to cost roughly $15,000.

One email released by the NCAA from an investigator who worked on the case said they wanted her to depose Allen because the NCAA "did not think he would interview with us again" otherwise.

Another point in the report was that an NCAA staffer bought a prepaid cellphone and paid for Shapiro's prison phone calls. The NCAA spent about $8,200 "to fund communications with Mr. Shapiro, including transfers of approximately $4,500 to his prison commissary account."

HDR mode to Android camera apps made possible by CyanogenMod

The CyanogenMod crew just announced that they have finally merged the HDR or High Dynamic Range functionality into the CM 10.1 camera app today. HDR is a process which makes multiple images of shots to be merged to produce a single photo called a panorama. This technique is widely used when a scene contains both bright and dark areas. It is also useful to add some funkiness to an image.

CyanogenMods version of HDR uses 3 images, one at minimum exposure and the other two at neutral and maximum respectively. It requires a very fast shutter speed as it is trying to capture 3 photos. The camera is needed to remain still as possible to avoid blurriness and disrupted perspectives. New cameras which have zero lag shutters are suited for this feature. For those who have lesser hardware specs, a tripod could be useful to capture an excellent quality image.

It is not just the capturing of three photos, the cpu should also be fast enough to stitch together those 3 photos into one. Ofcourse, CyanogenMod also added an option to users to delete the 3 photos taken after they are merged to save storage capacity.

The HDR feature is not working on Aries based devices but the team is already working for a solution.

Pistorius tells of 'terror' on night he shot girlfriend

The Olympic superstar appeared in a South African court Tuesday where he explained that he had accidentally shot his girlfriend, Reeva Steenkamp, because he mistakenly suspected she was an intruder. Prosecutors, however, aren't buying it. NBC's Michelle Kosinski reports.

?Blade Runner? Oscar Pistorius said Tuesday that he had heard a noise in the bathroom and felt ?a sense of terror? on the night he fatally shot his girlfriend Reeva Steenkamp, insisting he thought someone had broken into his South Africa home.

In a statement read to a court hearing, the double-amputee Olympic and Paralympic star wrote that he loved Steenkamp "deeply." He also said he had received death threats in the past and kept a firearm beside his bed.

Earlier Tuesday, Prosecutor Gerrie Nel insisted there was nothing to support Pistorius? claim that he feared there was an intruder in the house when he killed Steenkamp. She was shot dead through the door of a small bathroom in Pistorius? home in a suburb of Pretoria early on Valentine?s Day.

Nel said she had "nowhere" to go and her death must have been "horrific," insisting Pistorius was guilty of premeditated murder.

The NBC Olympic and "Rock Center" correspondent spent a week over the summer with Oscar Pistorius and tells NBC's David Gregory that he was a "gun guy" who was worried about his safety and security.

The claims were made at a bail hearing -- described as a ?little trial? by one expert -- that is being held to determine whether Pistorius should be freed pending trial.

Magistrate Desmond Nair?ruled that Pistorius would face a charge of premeditated murder, but the hearing was adjourned until Wednesday morning.

As the defense and prosecution lawyers argued, the family and friends of the slain model and law-school graduate Steenkamp held a tearful funeral?in her hometown.

As his statement was read to the court, Pistorius sobbed uncontrollably at times, prompting Nair to say, "I know it's difficult. ... I'm going to find it difficult to concentrate. ... Maintain your composure."

'She died in my arms'
The statement denied "in the strongest terms" that Pistorius had deliberately killed Steenkamp, adding that the athlete was "deeply in love'' with her, according to Reuters.

"I had no intention to kill my girlfriend," the statement said.

According to Pistorius' account, he and Steenkamp had decided to "have a quiet dinner together at home" and by about 10 p.m. they had retired to his bedroom, where she was doing yoga as he was lying down and watching television. After finishing her yoga, she got into bed with him and the two fell asleep, Pistorius' statement said.

During the early morning hours, it said, Pistorius woke up and went to his bedroom balcony to bring a fan inside and close the sliding glass doors and blinds.

"I heard a noise in my bathroom. ... I felt a sense of terror. ... I believed that someone had entered my house. ... I grabbed my 9mm pistol," it said.

Pistorius' statement said contractors had been working at his house and had left ladders outside, and there were no security bars on the bathroom window. The bathroom contained a separate toilet area with its own door.

?As I did not have my prosthetic legs on I felt extremely vulnerable. I had to protect Reeva and myself. ... I felt trapped as my bedroom door was locked and I have limited mobility on my stumps,? it said.

The statement then described Pistorius hearing movement inside the bathroom. "I fired shots at the toilet door and shouted at Reeva to phone the police," it said. "She did not respond and I moved backwards out of the bathroom, keeping my eyes on the bathroom entrance. Everything was pitch dark in the bedroom and I was still too scared to switch on a light. Reeva was not responding.

"When I reached the bed, I realized that Reeva was not in bed. That is when it dawned on me that it could have been Reeva who was in the toilet."

The statement also described Pistorius trying to open the locked bathroom door but failing, then grabbing a cricket bat to smash open the door. "Reeva was slumped over but alive. I battled to get her out of the toilet and pulled her into the bathroom."

Pistorius? statement said that moments after the shooting he ?picked Reeva up as I'd been told not to wait for the paramedics. ... She died in my arms.?

Earlier in the hearing, Nel said Steenkamp had arrived in Pistorius' home sometime between 5 p.m. and 6 p.m. on the night before she died.

There was "no possible explanation to support" Pistorius' claim that he thought Steenkamp was an intruder, Nel said.

And he added that even if Steenkamp had been an intruder, the shooting would still have been the murder of a burglar.

Nel said Pistorius had armed himself, put on his prosthetic legs, walked to the bathroom and shot Steenkamp several times through the locked door as she sat on the toilet. "She locked that door for a purpose," Nel said.

"If I arm myself, walk a distance and murder a person, that is premeditated," he said, according to Reuters. "The door is closed. There is no doubt. I walk seven meters (just over 22 feet) and I kill."

"The motive is 'I want to kill.' That's it," he added. "This deceased was in a 1.4- (4.5 feet) by 1.14-meter little room. She could go nowhere. It must have been horrific."

The prosecutor also asked why a burglar would have locked himself inside the bathroom.

After the shooting, Pistorius carried Steenkamp downstairs, where he met a security guard and a friend, according to the prosecution, and told them that he had thought she had been an intruder.

Pistorius' defense argued the sports star was not guilty of murder for that reason.

The defense lawyer claimed other husbands had shot their wives thinking they were intruders and asked, "Where's the premeditation?"

Following the defense's statements, Nel said he was now "more convinced" about what happened.

Karyn Maughan, legal correspondent for South Africa news channel ENCA, told NBC's TODAY that if a premeditated murder charge stands, there would be dire consequences for Pistorius.

?If he can?t prove that her death was unintentional, then it is unlikely he will get bail and he also faces a life sentence in jail,? she said. ?He must try to convince the court he shot her in confusion, thinking she was an intruder."

Pistorius has hired his own high-profile forensic expert to analyze the police reports and post-mortem exam, ENCA reported. His defense team includes lawyer Kenny Oldwage, who previously won an acquittal for a driver accused of killing Nelson Mandela's great-grandchild in a 2010 accident.

'Why my little girl?'
Model and law-school graduate?Steenkamp's relatives are hoping for answers.

"Why my little girl?" her mother, June Steenkamp, said?in an interview with The Times of Johannesburg,?calling her bubbly, blond daughter "the most beautiful person who ever lived."

"All we have is this horrendous death to deal with ... to get to grips with," she said. "All we want are answers ... answers as to why this had to happen, why our beautiful daughter had to die like this."

Steenkamp's family and friends gathered at a 90-seat chapel in Port Elizabeth, where Steenkamp grew up, for her funeral.

"She's my little sister and she's gone," her brother, Adam, told ENCA. "There is a big hole there that cannot be filled by anything else."

Steenkamp and Pistorius had been dating for about three months, and she tweeted a Valentine's Day message hours before her death.

The track star, who captivated the world when he became the first double-amputee to run in the Olympics at last summer's London Games, was a gun enthusiast who once took a reporter writing a profile of him to a firing range.

A South African newspaper reported Monday that he nearly shot a friend by accident while handling another friend's gun at a Johannesburg restaurant.

"I had quite a fright because the bullet hit the ground centimeters from my foot," boxer Kevin Lerena told the Beeld newspaper, according to Agence France-Presse.

"For some reason it got caught on his trousers, flipped the safety pin and a shot went off. I wouldn't say he was negligent. Days afterwards he was still apologizing."

Radio telescope, GPS use ionosphere to detect nuclear tests

Feb. 19, 2013 ? U.S. Naval Research Laboratory radio astronomer, Joseph Helmboldt, Ph.D., and researchers at Ohio State University Department of Civil, Environmental, and Geodetic Engineering analyzed radio telescope interferometry and Global Positioning Satellite (GPS) data recorded of the ionosphere during one of the last underground nuclear explosions (UNEs) in the U.S., codenamed Hunters Trophy.

Situated in the Plains of San Agustin, 50 miles west of Socorro, New Mexico, twenty-seven 25-meter parabolic dish antennas collectively make up the National Radio Astronomy Observatory's Very Large Array (VLA) radio telescope.

The VLA is an interferometer, meaning it operates by multiplying the data from each pair of telescopes together to form interference patterns. The structure of those interference patterns, and how they change with time as Earth rotates, reflect the structure of radio sources in the sky.

Designed as a radio synthesis telescope, observing bands between 1 and 50 gigahertz (GHz), the VLA is chiefly used to observe cosmic sources. While such observations require detailed calibration schemes to remove the effects of the ionosphere, this calibration data is seldom used to actually study the ionosphere.

During the Hunters Trophy event at the Nevada Test Site, Sept. 18, 1992, the VLA was observing a series of relatively bright cosmic sources at 1.4 GHz and positioned in a compact D-configuration, allowing an increased sensitivity to smaller-scale fluctuations. The data for these observations were retrieved from the VLA archives and self-calibration was performed using each source to obtain differences in total electron content (?TEC) time series for each antenna.

"One can see that between roughly 20 and 25 minutes after the UNE, the signature of disturbances in the ionosphere moving toward the northeast and southwest are nearly perpendicular to the direction from Hunters Trophy," said Helmboldt. "Given their characteristics, it seems likely that these disturbances are associated with small-scale distortions propagating along the larger traveling ionospheric disturbance generated by the Hunters Trophy explosion."

GPS can also contribute to detection and discrimination of UNEs. GPS signals are sensitive to ionospheric disturbance, and this phenomenon can be used to further validate concurrent VLA measurements. By studying the ionosphere, namely Traveling Ionospheric Disturbances (TIDs) excited by acoustic-gravity waves from surface and underground explosions, the magnitude of the fluctuations greatly increased roughly 30 minutes after detonation -- consistent with GPS-derived propagation speed. The travel time and the travel distance of each event are highly correlated.

"Combining the results of both spectral techniques, we found a class of intermediate and small-scale waves," said Helmboldt. "Our exploration of VHF/UHF observations with the VLA has successfully demonstrated the power of this instrument to characterize a variety of transient ionospheric phenomena."

The resolution of the VLA is set by the size of the array -- up to 36 km (22 miles) across. At its highest frequency (43 GHz) a resolution of 0.04 arcseconds is achieved -- sufficient to see a golf ball being held 150 km (100 miles) away.

President Obama used his State of the Union address to launch a push for massively expanding pre-K and other early childhood education programs. But he was pretty vague about it. Not anymore. At 6 a.m. today, the administration released its detailed plan for early childhood education. Its three main components are:?

  • A state-federal partnership to guarantee pre-K to all 4-year-olds in families at or below 200 percent of the poverty line, to be provided by school districts and other local partners, and to use instructors with the same level of education and training as K-12 instructions.?
  • A massively expanded Early Head Start program ? building on the existing program, which has proven very effective in randomized controlled trials ? which provides early education, child care, parental education, and health services to vulnerable children ages 0 to 3.?
  • Also expanding Nurse Family Partnerships, a program that has also earned top marks in randomized trials, and which provides regular home visits from nurses to families from pregnancy through the child?s second birthday, intended to promote good health and parenting practices. update ? it appears that the White House program is broader than just NFPs but the general practice is the same, if less well-evaluated. Sorry for the confusion?

Upon opening the plan for the first time (while on the phone with me) Nobel laureate and early childhood education expert James Heckman exclaimed ?Holy smokes!? in approval.?

As somebody who has spent the majority of their life working with young children, I can only echo that "Holy Smokes!"

I have spent more than my fair share of time in the trenches working to provide children a head start before entering Kindergarten, and then later assisting them once there, and I have OFTEN wished for better funded and staffed programs that could do what I was trying to do on what amounted to a shoestring budget.

Preschool for All?

The President?s proposal will improve quality and expand access to preschool, through a cost sharing partnership with all 50 states, to extend federal funds to expand high-quality public preschool to reach all low- and moderate-income four-year olds from families at or below 200% of poverty. The U.S. Department of Education will allocate dollars to states based their share of four-year olds from low- and moderate-income families and funds would be distributed to local school districts and other partner providers to implement the program. The proposal would include an incentive for states to broaden participation in their public preschool program for additional middle-class families, which states may choose to reach and serve in a variety of ways, such as a sliding-scale arrangement.?

Funds will support states as they ensure that children are enrolled in high-quality programs. In order to access federal funding, states would be required to meet quality benchmarks that are linked to better outcomes for children, which include:?
State-level standards for early learning;?
Qualified teachers for all preschool classrooms;?
and A plan to implement comprehensive data and assessment systems.?

Preschool programs across the states would meet common and consistent standards for quality across all programs, including:?

  • Well-trained teachers, who are paid comparably to K-12 staff;?
  • Small class sizes and low adult to child ratios;?
  • A rigorous curriculum;?
  • Comprehensive health and related services;?
  • and Effective evaluation and review of programs.?

The proposal also encourages states to expand the availability of full-day kindergarten. Only 6 out of 10 of America?s kindergarten students have access to a full day of learning. In order to ensure that our kindergartners spend the time they need in school to reach rigorous benchmarks and standards, funds under this program may also be used to expand full-day kindergarten once states have provided preschool education to low- and moderate-income four year-olds.?

Under the President?s proposal, investment in the federal Head Start program will continue to grow. The President?s plan will maintain and build on current Head Start investments, to support a greater share of infants, toddlers, and three-year olds in America?s Head Start centers, while state preschool settings will serve a greater share of four-year olds.?

Quality Early Learning for Our Youngest Children?

The President will also launch a new Early Head Start-Child Care Partnership program, to support states and communities that expand the availability of Early Head Start and child care providers that can meet the highest standards of quality for infants and toddlers, serving children from birth through age 3. Funds will be awarded through Early Head Start on a competitive basis to enhance and support early learning settings; provide new, full-day, comprehensive services that meet the needs of working families; and prepare children for the transition into preschool. This strategy ? combined with an expansion of publicly funded preschool education for four-year olds ? will ensure a cohesive and well-aligned system of early learning for children from birth to age five.?

The President is proposing to expand the Administration?s evidence-based home visiting initiative, through which states are implementing voluntary programs that provide nurses, social workers, and other professionals to meet with at-risk families in their homes and connect them to assistance that impacts a child?s health, development, and ability to learn. These programs have been critical in improving maternal and child health outcomes in the early years, leaving long-lasting, positive impacts on parenting skills; children?s cognitive, language, and social-emotional development; and school readiness. This will help ensure that our most vulnerable Americans are on track from birth, and that later educational investments rest upon a strong foundation.?

You know each of us have our own closely held concern for the direction that our country is headed.

For some it is concern about our economic future. For others it is all about defense against terrorists, or foreign countries with hostile feelings toward America. But for me it has always been education.

That is the concern that keeps me awake at night, That is perhaps the one issue that I want EVERY politician to focus on above all other things.? Because to me there is simply nothing even remotely as important to the future of our nation, and of our people, as having our children receive the best education possible, as early as possible.

That is why I rail against turning public schools into for profit charter schools. That is why I complain so vociferously about standardized testing turning our children into robotic cogs in a test taking machine. That is why I gnash my teeth and tear out my hair at the very notion that Creationism might be taught alongside science.

This gives me hope that finally we are taking education seriously and have a real plan for dealing with the problems that plague our public schools.

I have been listening to some debate about this new policy that is focused on money and where it will come from.?

Who gives a shit? The return on this investment simply cannot be accurately calculated. It will be HUGE!

A better educated population is one that has highly developed critical thinking skills. They will be better suited to compete with other nations in every field you can imagine. They will be comfortable with changing technologies, proficient with faster information gathering tools, and better equipped to move this nation forward.

There are other perks as well.

They will be less likely to be convinced that wrong is right, less likely to support the start of an unnecessary war based on false pretenses, less likely to be seduced by image over substance, and less likely to vote against their better interests.

Hmm, I guess now that I think about it there might be a few individuals sent into a blind panic over this new plan.? Pay close attention to who speaks out against it, and then ask yourself what is it that they REALLY fear? And why?
